Terms of Service

These Terms of Service (“Terms”) govern your access to and use of CueCard (“CueCard,” “we,” “our,” or “us”). By creating an account or using the service, you agree to these Terms. If you do not agree, please do not use CueCard.

The service

CueCard helps you remember birthdays and schedule birthday email messages to the contacts you add. We provide a free tier and a paid “Pro” tier with higher sending limits and additional features.

Eligibility & your account

You must be at least 18 years old, or the age of majority where you live, to use CueCard. You are responsible for activity that happens under your account and for keeping access to your sign-in email secure. You agree to provide accurate information and to keep it up to date.

Acceptable use

You agree not to use CueCard to:

• send unsolicited bulk email, spam, or messages to people who have not agreed to hear from you. You represent that you have an appropriate relationship with, and the necessary permission to email, each contact you add;
• send unlawful, harassing, deceptive, infringing, or harmful content;
• impersonate any person or misrepresent who a message is from;
• attempt to disrupt, reverse-engineer, scrape, or gain unauthorized access to the service; or
• violate any applicable law, including anti-spam laws such as the U.S. CAN-SPAM Act.

You are solely responsible for the content of the messages you create and send through CueCard. We may suspend or terminate accounts that we reasonably believe violate these Terms.

Subscriptions, billing & auto-renewal

Pro is offered as a recurring subscription billed either monthly or annually, at the prices shown at checkout (currently $5 per month or $48 per year, a savings of about 20% versus paying monthly). Payments are processed by Stripe; by subscribing, you also agree to Stripe's terms.

Your subscription renews automatically at the end of each billing period (monthly or yearly) at the then-current price, and your payment method is charged automatically, until you cancel. You authorize us and Stripe to charge your payment method on a recurring basis.

You can cancel at any time from the accountpage via “Manage billing,” which opens the Stripe customer portal. Cancellation stops future renewals; your Pro access continues until the end of the billing period you have already paid for. See our Refund & Cancellation Policy for details.

We may change subscription prices or the features included in a plan. If we change the price of a plan you are subscribed to, we will give you advance notice by email, and the new price will apply to your next renewal after the notice period. You may cancel before then if you do not agree.

Taxes

Prices may be exclusive of applicable sales tax, VAT, or similar taxes, which may be added at checkout based on your location.

Your content

You retain ownership of the contacts, messages, and other content you provide. You grant us the limited rights needed to host, process, and send that content in order to operate the service for you. You are responsible for having the rights and permissions necessary to use that content.

Disclaimers

CueCard is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that scheduled messages will always be delivered on time, as email delivery depends on third parties and recipients' mail providers.

Limitation of liability

To the maximum extent permitted by law, CueCard and its operator will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill arising out of or related to your use of the service. Our total liability for any claim relating to the service will not exceed the greater of the amount you paid us in the twelve months before the claim or US $50.

Termination

You may stop using CueCard and delete your account at any time from the account page. We may suspend or terminate your access if you violate these Terms or if we discontinue the service. Upon termination, your right to use the service ends; sections that by their nature should survive (such as disclaimers, limitation of liability, and governing law) will survive.

Governing law

These Terms are governed by the laws of the State of Colorado, USA, without regard to its conflict-of-laws rules. You agree that any dispute will be resolved in the state or federal courts located in Colorado, except where applicable law gives you the right to bring a claim elsewhere.

Changes to these Terms

We may update these Terms from time to time. When we do, we will change the “Last updated” date above, and we will notify active users of material changes by email. Your continued use of CueCard after changes take effect means you accept the updated Terms.
